Abstract

This analysis examines critically about economic factors as the cause of divorce in the Syar'iyah Idi Court in East Aceh Regency, among others, Divorce and livelihoods, including the Definition of Divorce and Sources of Divorce Law, Divorce According to Islamic Law, Principles of Divorce Law, Divorce Legal Process in the Syar'iyah Idi Court and Theories About Living. This analysis is trying to formulate economic factors as the cause of divorce in the Idi Syar'iyah Court. Furthermore, it provides a view of the judges and employees of the Syar'iyah Idi Court and the community in general on significant issues to be discussed, so that it will provide clarity and obtain data on economic factors as causes of divorce in the Syar'iyah Idi Court. This analysis uses the field research method and is quantitative in nature, through this method the writer analyzes it thoroughly in the form of data at the research location in accordance with the focus of the problem, by examining it directly to the Syar'iyah Idi Court in East Aceh Regency. To obtain accurate and reliable data on the causes of divorce, both on the position and authority, complaints, proceedings, decisions and legal consequences that arise as well as their effects on domestic life. The results of this study are, the factors behind the occurrence of divorce are based on existing data in the lawsuit and decisions which are very dominant causes of divorce claims due to internal and external factors. Internal factors include, the husband is not responsible for providing a living when he is able, the income provided by the husband is not enough to meet the needs of the family, the husband is unable to provide a living because the husband is poor due to many debts, lazy work that burdens his wife and family, wife's attitude is not satisfied with the gift of the husband and too demanding in giving a living. External factors are the weakening of the economic sector and the limited employment, such as rising prices of goods, it is difficult to find work that has an impact on economic needs in the household so that family livelihood is disrupted and trigger family disharmony. The two factors mentioned above are indicators of the causes of the high number of divorce claims due to economic factors in the Syar'iyah Idi Court. The results of this study are, the factors behind the occurrence of divorce based on data available in the suit and the ruling which are the most dominant factors divorce due to internal and external factors. Internal factors include, the husband is not responsible for providing a living when he is able, the income provided by the husband is not enough to meet the needs of the family, the husband is unable to provide a living because the husband is poor due to many debts, lazy work that burdens his wife and family, wife's attitude is not satisfied with the gift of the husband and too demanding in giving a living.
